Immunity Can’t Save Fayose from Prosecution – Aisha Buhari

The First Lady Aisha Buhari has said that Section 308 of the constitution which protects governors from criminal and civil prosecution cannot save Ekiti state governor Ayo Fayose from prosecution.

She said this through her lawyer, who filed a statement of claims before an FCT High Court to kick off the defamation suit challenging Governor Fayose’s allegation linking her with the Halliburton bribery scandal in the United States.

According to Daily Trust, Mike Ozekhome (SAN), Fayose’s lawyer had argued in a reply to a pre-action notice filed by Aisha Buhari’s camp that Section 308 of the constitution meant that Mrs. Buhari’s hands are tied when it comes to the prospect of suing Fayose and that she should wait till 2018 to make a move against the governor.

But Mrs. Buhari hit back through her lawyers stating that criminal charges on the murder of one Tunde Omojola, diversion of N1.2bn state funds in 2004 and the invasion of the Ekiti High Court with thugs who allegedly beat up a judge in 2014 were some of Fayose’s alleged crimes and he cannot hide under the constitution to escape his many alleged crimes.

“The first defendant (Fayose) is a well-known coward who is scared of facing the consequences of his numerous indiscretions and sheer acts of criminality by timidly hiding under the cloak of immunity to want to evade prosecution,” she averred.
