Police captain had sex with women without revealing that he is HIV positive.

A retired police captain was jailed after he had sex with women without telling them that has HIV. 


67-year-old Charles G. Martina, who was the police captain in Plainfield, New Jersey, was sentenced to 364 days in the Somerset County Jail. 

 

Martina, who was taken out of the courtroom in handcuffs, was also sentenced to 3 years of probation and must pay the two victims for their medical expenses. 

Judge Julie M. Marino also ordered him to undergo a psychological evaluation and treatment if recommended.

Martina of North Plainfield, pleaded guilty to two counts of diseased person committing an act of sexual penetration, a third-degree crime, after he was unsuccessful in getting the charges dropped.

He faced up to 10 years in prison if found guilty of the charges. 

Martina, who was head of the Plainfield police narcotics and vice squad, was charged after 2 women came forward to say that they had sex with him, but he did not tell them that he has HIV, the virus that causes AIDS.

According to the complaint, a 45-year-old woman had a relationship with Martina for 3 years.

A 61-year-old woman said that she had sexual relations with him for about 6 months.

Martina retired as captain after nearly 28 years with the Plainfield Police Department.
