Court Dismisses Nyako’s Suit Asking To Be Reinstated As Governor

A Federal High Court sitting in Yola has ruled out the move by the impeached governor of Adamawa state, Murtala Nyako to be reinstated.

A suit instituted by Nyako, claiming he was wrongfully removed was dismissed by Justice Bilikus Aliyu on Thursday, May 21, describing it as an abuse of court process.

The judge said three suits on the same issue are pending before a competent court of law.

She said, “I cannot continue with this case as the courts run concurrently. We will not encourage litigants abusing court processes. The case is hereby dismissed.”

The counsel to the state assembly, Leonard Zadon, had objected Nyako’s suit, arguing that the same case is pending before three high courts.

Aliyu had earlier supported the appellant’s argument that his right was grossly infringed upon by the respondents, citing section 36 of the 1999 constitution.
