Court strikes out Busola Dakolo’s suit against Biodun Fatoyinbo

A Federal High Court in Bwari, Abuja on Thursday struck out the suit filed by Busola Dakolo against Biodun Fatoyinbo of the Commonwealth of Zion Assembly (COZA).

Okay.ng understands that the court also awarded costs of N1,000,000 against Dakolo and held that the fine should have been 10 times more because the court’s time was wasted.

Justice Oathman A. Musa, in giving the judgment, held that the matter amounts to injustice and an abuse of judicial process adding that the case is empty and purely sentimental. Justice Musa said that the case was aimed more at cruelty than obtaining justice.

It can be recalled that Busola Dakolo, the wife of Nigerian singer, Timi Dakolo accused Biodun Fatoyinbo of allegedly raping her repeatedly in 2002

Fatoyinbo’s lawyer, Dr. Alex Izinyon (SAN), aruged during the trial on Thursday that the suit were ungrantable by the court and that the suit was frivolous and an abuse of court process.
