The Federal High Court in Abuja has adjourned the suit filed by Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), against the Federal Government until April 22, 2024.

In the suit marked FHC/ABJ/CS/462/2022, Kanu accuses the government of kidnapping him from Kenya and bringing him to Nigeria for trial.

Kanu, who is currently in the custody of the Department of State Services (DSS), seeks several reliefs, including an order for his release and a demand for N50 billion in damages.

The suit questions the legality of trying him for offenses listed in the amended charge, given the circumstances of his arrest and rendition to Nigeria.

The Federal Government and the Attorney General of the Federation (AGF) have, in a preliminary objection, described the suit as an abuse of the court process.

They argue that Kanu had filed a similar suit with the same facts before a Federal High Court in Umuahia.

During the proceedings on Monday, Aloy Ejimakor informed the court that he had taken over the case from Mike Ozekhome (SAN).

Justice Inyang Ekwo directed Ejimakor to ascertain if a similar matter was before another court or if a judgment had been delivered in a similar suit.

The judge further ordered the issuance of a hearing notice to be served on the defendants, who were absent during Monday’s proceedings.

The court will reconvene on April 22, 2024, for further deliberations on the matter.
