Supreme Court Upholds Peter Mbah’s Election as Enugu State Governor

The Supreme Court has delivered a decisive judgment affirming the election victory of Governor Peter Mbah of Enugu State.

Justice Mohammed Garba, who led the panel, dismissed the appellant’s claim that Mbah lacked the National Youth Service Corps (NYSC) certificate, describing it as a mere allegation.

The appellant, Chijioke Edeoga of the Labour Party, had approached the court to challenge the decision of the Court of Appeal, which had earlier dismissed his case against the election of Governor Peter Mbah.

The unanimous decision of the Lagos Division of the Appeal Court had resolved all three issues against Edeoga.

The three-member panel, presided over by Justice Tani Hassan, ruled that the appellant failed to provide evidence proving that Governor Peter Mbah was not qualified to contest the governorship election.

Additionally, the court dismissed the allegation of over-voting, emphasizing that the voters’ register was not tendered before the lower tribunal, rendering the appeal inadmissible.

Justice Mohammed Garba, in delivering the lead judgment at the Supreme Court, reiterated the court’s commitment to upholding the rule of law and ensuring that electoral disputes are decided based on the merits of the case.
