Court of Appeal Upholds N5 Million Fine Against Daddy Freeze for Adultery

The Court of Appeal in Port Harcourt has upheld the N5 million fine imposed on popular Nigerian On-Air Personality, Ifedayo Olarinde, widely known as Daddy Freeze, for committing adultery. This decision comes after the High Court in Port Harcourt, Rivers State, ruled on February 18, 2021, that Daddy Freeze should pay the sum for engaging in an extramarital affair with Benedicta Elechi.

The High Court had ordered Daddy Freeze to compensate Paul Odekina, who was married to Elechi at the time of the affair. The court found that Daddy Freeze’s actions deprived Odekina of the “amiable consort” of his wife and caused him emotional injury.

In addition to the financial penalty, the court also dissolved the marriage between Paul Odekina and Benedicta Elechi due to the adulterous act.

Daddy Freeze, dissatisfied with the High Court’s ruling, sought redress from the appellate court. His primary contention was that Odekina did not attempt to serve him personally before resorting to substituted service, which he argued was a violation of Order 7 Rule 2 of the Rules of the Trial Court. However, the Court of Appeal dismissed his appeal and upheld the original judgment.
